How Mediation Works
Mediation is a structured settlement process led by a neutral mediator trained in resolving disputes. Unlike a judge, the mediator does not make legal findings or issue binding decisions but instead guides parties toward resolution.
Mediation typically unfolds in three stages:
General Session
All parties and their attorneys meet with the mediator, who explains the process and ground rules. Each attorney then presents their client’s position, outlining key legal and factual issues.
Private Discussions
The parties move into separate rooms, and the mediator shuttles between them, conveying settlement offers confidentially. These discussions allow for open dialogue on interests, settlement flexibility, and case strengths and weaknesses.
Settlement Agreement
If an agreement is reached, the mediator helps document the essential terms for all parties to sign.
Mediation is confidential and privileged, meaning nothing discussed can be disclosed outside the process. The mediator only reports to the court whether a settlement was reached, in accordance with Texas Civil Practices & Remedies Code 154 and Texas Rules of Evidence 604.

Online Video Mediation
Wayne is available to travel anywhere in Texas, but offers clients the option of virtual mediation to avoid covering travel expenses. Online mediation has the same structured process as in-person mediation, with the key difference being that all parties connect via Zoom video conference. As the mediator, Wayne controls the session layout, facilitating joint discussions, private caucus rooms, and confidential attorney-client meetings, just as in traditional mediation.

Mediation Services
Wayne provides in-person mediations across Texas, meeting clients where they are while maintaining his practice in Conroe. Mediating in Conroe includes a locally sourced lunch for full-day sessions, while travel-related expenses for out-of-town mediations are shared on a pro-rata basis.
Full Day Mediation
Full-day sessions begin at 9:30 am and conclude at 4:00 pm. Fees include lunch, beverages, snacks, and free parking. Highly specialized and/or complex cases may require higher fees per party.
$1700 per party
Half Day Mediation
Half-day sessions include beverages, snacks, and free parking. Morning sessions begin at 9:00 am and conclude at 12:00 pm. Afternoon sessions begin at 1:30 pm and conclude at 4:30 pm.
$850 per party
